‘Rang De Basanti’ copyright infringement case: Rakeysh Omprakash Mehra gets relief from Aurangabad court | Hindi Movie News – Bollywood


While giving relief to the breathtaking filmmaker Rakeysh Omprakash Mehra in the movie ‘Rang De Basanti‘copyright offense case, the Aurangabad court acquitted him of all the charges made by a writer and accused him and the producers of the film of plagiarism. The cession court earlier in the case gave relief to the producer of the film Ronnie Screwala. He moved the Sessions court which set aside the magistrate’s court order of issuing process. The trial court noted that the ‘criminal proceedings themselves were not tenable as the story’ Inquilab ‘was not registered’ and that there was no ‘prima facie material to cover the offenses punishable under the Copyright Deed’. Writer Mustaq Mohsin particularly approached the court, claiming that he had discussed a screenplay entitled ‘Inquilab’ with the filmmaker, but Mehra used the same screenplay for his film ‘Rang de Basanti’, which was released in the year 2006. Now, while relying on Sessions court order, the Magistrate’s Court noted that the current proceedings by a Sessions court are binding on the lower court. In the course of the trial, Rakeysh filed an application for dismissal on the ground that no offense was made to the issuance process. He argued that the story of ‘Rang De Basanti’ was original and different from the screenplay of ‘Inquilab’. While saying that there is no copyright for an idea, he also made an argument in his application that under the Copyright Act there is no barrier to producing identical results using the same idea. He also claimed that the writing discussed by the author was not copyrighted, nor was it published. The filmmaker further stressed that the whole dispute is civil in nature and said that ‘the intention to prosecute is to obtain unwanted publicity through abuse of police and judicial machinery’. Meanwhile, on the work front, Rakeysh Omprakash Mehra is best known for films such as ‘Delhi-6’, ‘Rang De Basanti’, ‘Bhaag Milkha Bhaag’ and most recently ‘Toofan’.
