Responding to Dnyandev Wankhede’s lawyer’s argument as to why Sameer should provide any justifications to a person who ‘is only an MLA and not a court’, the court said: ‘You are a public servant. … you just have to prove that the tweets posted by Nawab Malik is prima facie false … Your son is not only an individual but a public servant and may be investigated by any member of the public. ‘ On the other hand, the court also gave an audience to Nawab Malik’s lawyer, as the court said: ‘Is it not your duty to verify the documents before you post them? Have you verified the authenticity of the documents as a responsible citizen and spokesperson of a national party? ‘ Post this, the court asked Malik’s lawyer to submit an affidavit stating that he had verified the documents before posting or publishing them on Twitter. Meanwhile, Wankhede’s lawyer sought time to file an additional affidavit to establish that the allegations raised by Nawab Malik were completely false and false. The matter will now be heard on 12 November. In particular, Dnyandev Wankhede filed a defamation suit, saying that Nawab Malik’s claim that he was a Muslim amounted to questioning the family’s religious beliefs and caused irreparable damage to the family’s reputation. Nawab Malik had earlier claimed that Sameer was born a Muslim and had forged his birth certificate to get a job in the Scheduled Castes quota.
